United States v. Arizona — How ‘Bout United States v. Rhode Island?

This suit is not about reversing Arizona’s law. It’s about getting a stay for it’s implementation.  It makes the current group of racist frauds in the Obama/Holder Injustice Department, appear that they are backing the Mexicans while in reality, they are hoping for their votes.  From the beginning it has never made any sense, how can a law that is the same as the federal law, but provides more rights to potential violators ever be deemed Unconstitutional. It can’t, It won’t, is pure race bating at it’s finest.

The Obama administration is creating multiple racial divides, and that’s its plan.  Rational thoughts while observing Obama’s charade, I’m J.C.

Well whaddya know? It turns out that Rhode Island has long been carrying out the procedures at issue in the Arizona immigration statute: As a matter of routine, RI state police check immigration status at traffic stops whenever there is reasonable suspicion to do so, and they report all illegals to the feds for deportation. Besides the usual profiling blather, critics have trotted out the now familiar saw that such procedures hamstring police because they make immigrants afraid to cooperate.

But it turns out that it’s the Rhode Island police who insist on enforcing the law. As Cornell law prof William Jacobson details at Legal Insurrection, Colonel Brendan P. Doherty, the state police commander, “refuses to hide from the issue,” explaining, ”I would feel that I’m derelict in my duties to look the other way.”
If, as President Obama and Attorney General Holder claim, there is a federal preemption issue, why hasn’t the administration sued Rhode Island already? After all, Rhode Island is actually enforcing these procedures, while the Arizona law hasn’t even gone into effect yet.

Could it be because — as we’ve discussed here before — the Supreme Court in Muehler v. Mena has already held that police do not need any reason (not probable cause, not reasonable suspicion) to ask a person about his immigration status?

Could it be that just this past February, in Estrada v. Rhode Island, the U.S. Court of Appeals for the First Circuit upheld the Rhode Island procedures, reasoning that, in Muehler v. Mena, the Supreme Court “held that a police officer does not need independent reasonable suspicion to question an individual about her immigration status…”?

So, we have a Justice Department that drops a case it already won against New Black Panthers who are on tape intimidating voters in blatant violation of federal law, but that sues a sovereign state for enacting a statute in support of immigration enforcement practices that have already been upheld by two of the nation’s highest courts. Perfect.

    HA HA HA HA This is great!
    Being a former Rhode Islander I could tell you stories about the reality of life in that state. It is by no means easy on criminals of any sort. The cops there are always on the job doing what the law rquires them to do. I got to know many of the men on the force in Jamestown and New Port when I lived there. We used to hang out at Aidans Pub after hours trading tales of the life as we saw it. If any of you get to New Port, go to Aidans Pub and look some of my old friends Duncan Disorderly and English Dave, Jim McGrath, Larry Jameson, Brian Sulivan. They’ll show you a really great time. If you get to Jamestown go to the Narragansette Tavern on Main Street. They have some really great bands there and the place is usually packed on weekends with folks dancing up a storm. There are some really great restaurants there as well I so can guarantee you that the trip will be well worth your while.

  3. The moratorium on drilling that was struck down by the federal judge, and now being appealed by the DOJ should indicate Obamas’ direction towards the economic history of this country.
    His ego will defeat him.
    The elites are now rebelling against Obama policies on an increasing basis.
    Big business, Verizon, GE, and Hollywood elites are seeing the writing on the wall, that the regime is going to steal them blind is they can.

    The rest of the people out there living in a fog of ignorance had better get the message fast.
    The lawsuit against Arizona is grandstanding in it’s simplest form, just to potentially increase the latino voter base if amnesty is passed.
    His grinning rhetoric strikes a chord only with the ill-informed, ………who vote.

  5. It’s simply because AZ is a gateway for illegals, RI is not. This regime wants to give amnesty to as many illegals as possible, and they need the open border in AZ.

Must throw the garbage out from Congress in Nov. and make Barry Sotoro go one down in history as THE WORST PRESIDENT THIS COUNTRY HAS EVER SEEN. Sickening thought he will always be teflon and well guarded by taxpayer $$$ for as long has he has a pulse. He doesn’t deserve to be able to reap one more penny of US taxpayer $$$ b/c all he has done is work on hurting this nation as much as he can while in office. I’m SICK SICK SICK SICK SICK of pundits and media STILL SAYING, “he doesn’t get it, he’s incompetent….!” Everything he is doing is by design and purposeful! I hope he is miraculously forced to resign – and pay back all the dang ka-ching he is robbing from this nation! WHO is going to dare tell the Muslims we’re sorry but we really don’t want to make them feel good about NASA and the deal is off? If millions of illegals are granted amnesty, then that will be millions more mouths to feed on the Donkey’s teat! Lots is so destructive, no politican alive will reverse those damaging pieces of legislation!

  9. Can this ridge runner talk now, JC? I’ll try to get these folks back to the issue of gettin’ the rogue DoJ outta’ Dodge.
    The center of the Chicago Czars’ basketball team will dribble and pass their slimy balls with a full press against the the AZ Brewers in order to keep them from their home hoop until November has passed. By then the Chicago Crazies will accrue another few million fans for the WADC team.
    I suggest the Brewers should break the press by inducing the Shitgo Bulls to commit a wrist foul and go to the line and shatter Obummer’s backboard.
