Dear Members of the Clemency and Parole Board,

I am writing to indicate my support for Corey Clagett in his upcoming clemency hearing on June 3, 2011. By reading about Corey’s case I learned about to the facts of his incarceration and I feel that a grave injustice has taken place. I believe in the arguments of Corey’s attorney, Tim Parlatore, and hope that you find them persuasive as well.

First, I believe the American justice system should not punish soldiers, fighting to protect the very sacredness of that system, in the same way it punishes those who commit heinous crimes here within our own borders. A killing in the midst of war is not the same as a premeditated murder in the United States and the punishment should reflect this difference.

Second, instead of being locked up, I believe Corey needs psychological treatment from the VA. Even though Corey committed a wrong, I feel strongly that the four years in solitary confinement he has already served is more than enough and he now deserves rehabilitating treatment.

Third, as I understand it, Corey’s sentence is much longer than those who committed the crime with him, specifically the man who ordered Corey to kill the Iraqi. This information came as a complete shock to me, how is that justice?

Finally, I believe that Corey should receive a lower sentence because he chose to cooperate with the Government. Corey’s cooperation showed me that he was taking responsibility for his actions.

Thank you for giving me the chance to write on behalf of a cause I care deeply about. As an American, I hope that Corey’s clemency petition will be granted and that he will be released.

Background information:

PFC Corey Clagett was serving in Iraq with the 101st Airborne Division in 2006, when he was arrested and imprisoned for murder  following orders during Operation Iron Triangle.  He was only 21 years old when Corey’s squad was sent into Thar-Thar with orders to “kill all military aged males.”  When they instead took three Iraqis prisoner, he and Specialist William Hunsaker were ordered to release the detainees and kill them.

When Pfc. Clagett was charged, he was unable to obtain a civilian lawyer to represent him. Finally one did free of charge, only to have him abandon Corey just days before trial.

Represented by an inexperienced JAG lawyer, prosecutors threatened Corey life in prison or the death penalty.  He agreed to plead guilty in exchange for an 18 year sentence.

All those involved and of higher rank were and advised to plead to different charges and were sentenced and subsequently released within 9 month to 3 years. No officers as part of the plea agreement were to be named that gave the orders.  No officers received court martial yet Corey rots in Leavenworth.

First I would like to say thanks to all of you who have supported this young man and his family.  This is now the most important part of the operation.  Now, it’s our turn. This is not a poll to sign that will go no place, this will be your letter delivered to  the Chairman, Army Clemency and Parole Board.

Many of you have read my articles on freeing Pfc. Corey Clagett, wrongly imprisoned in Leavenworth, Kansas in solitary confinement.  Long story short, Corey followed a direct order on a mission early in Iraq in the area of Thar-Thar to kill all males of military age.

Your version of this letter must be sent to the Corey’s attorney by mail or Fax. Just follow your heart.  Your letters to Corey and your contributions have been so helpful, that his Mom, Melanie can afford to attend by air, her hotel is comped. Any help is still greatly appreciated for the financial defense.

  1. I printed this letter, filled it out and attempted to Fax. Error console stated that the line was either busy or no signal. I never heard the “Hand Shake” between the two Fax Machines.

    I will attempt again later. If I have to I will snail mail it.
