‘Shall not be infringed’ used but once in Constitution

Progressives often cite differences of opinion among the Founders of our nation concerning a variety of issues as some sort of “proof” that they were deeply divided on matters related to independence and human liberty.

But actually they weren’t.

It is highly doubtful that progressives have read the Federalist Papers and what led up to the actual penning of the Declaration of Independence, The Constitution and Bill of Rights.

Both Madison and Jefferson argued extensively that citizens are under no obligation to obey unconstitutional laws. The question, thus, becomes, how many more infringements will the patriots allow before a tipping point is reached?

Among the Founders there was broad agreement on several key principles, among them being that human beings are meant to be individually free and not slaves, liberty is worth dying for, government is meant to be as small as possible and exists only to protect human liberty, and going to war is an acceptable means of securing those liberties.

The only real disagreement among the original patriots revolved around the details. How do we best implement and maintain a society where liberty is valued, propagated, and protected? (Entire article below)

On these sub-points there was significant disagreement, and thus, the need for at least some compromise, that is, up to a point. For example, although Thomas Jefferson had originally written into the Declaration of Independence that all men are created equal, even slaves, he was met with great resistance at the Continental Congress from representatives from the southern colonies. In order to reach a consensus and forge an agreement, concessions had to be made to the southern colonies that would allow them to continue a practice upon which their entire economy was based, which unfortunately was slavery.

And when the Constitution itself was presented before the Congress, there was significant resistance to approving it, not because some of the patriots opposed the concepts it contained but due to two issues that had nothing to do with the broad principles it promoted. The first was that the original Constitution contained no Bill of Rights, and the second was that some of the patriots feared that such a Constitution would erode the power of the states.

In order to address these concerns the Framers constructed a Bill of Rights that was sent around to the various state legislatures for consideration. That Bill would finally be approved once it became clear that it contained a provision, known as the 10th Amendment, which protected the sovereignty of each state, and once it became known that the entire Bill — the first 10 amendments to the Constitution — placed strict, specific limitations on the federal government, which satisfied the concerns of some of the patriots that the Constitution would create an all-powerful central authority.

Various phrases were used in describing these provisions, the most noteworthy being, “Congress shall make no law,” regarding limits on free speech, a free press, the freedom of religion, and the freedom of the people to assemble.

One phrase, however, stands out above the rest due to the fact that it is the only time in the entire Constitution that these particular words are used. It is stark in its finality, crystal clear in its prohibition, and entirely unambiguous in its meaning.

“The right of the people to keep and bear arms shall not be infringed.”

Shall not be infringed. The only time this phrase is used in any of our founding documents is when applied to the Second Amendment, the right of the citizens to own and carry firearms.

“Shall not be infringed” prohibits government from placing any restrictions whatsoever upon the citizens to use guns and ammunition in self-defense. And self-defense in this instance includes but is not limited to resistance to a tyrannical government, which the Framers feared would one day spring up in our own nation.

Why, then, would the Framers be so adamant about the right to keep and bear arms? When writing about speech, religion, the press, and assembly, the operative phrase is, “Congress shall make no law…” That, too, is pretty clear and final.

But the phrase “shall not be infringed” carries an even stronger connotation. Why?

From the historical record it is abundantly clear that the Founders knew that had it not been for guns and ammunition they would have never secured the other freedoms delineated in the Constitution. Had they not taken up arms against the tyrannical British monarchy of King George, they never would have won the freedom to speak without fear of persecution or reprisal, the freedom to worship as they pleased apart from an official state church supported by tax dollars, the freedom to write what they wanted in a free press, nor the freedom to assemble to discuss grievances against the government.

The Second Amendment, thus, gave us the other freedoms delineated in the Bill of Rights. Gun rights, therefore, are our first freedom.

When tyrannical governments, such as the British monarchy in the 1700s, refused to hear or respond to citizen complaints, then the people, declared our Founders, had the right to use force, deadly force, to secure the rights to which King George had turned a deaf ear.

Although modern Americans are often led to believe by the propaganda being taught in the nation’s public schools that the colonists’ chief complaint against King George was “taxation without representation,” that issue was only the tip of the iceberg. The issue that became the proverbial straw that broke the camel’s back was that the Crown wished to deny to the colonists access to their guns.

This is what pushed the colonists over the edge. And a War of Independence ensued.

For nearly a century the U.S. government has slowly and gradually infringed on the right of the people to keep and bear arms — the very thing the Second Amendment prohibits with strong language. That slow trickle has now become a raging torrent that threatens to so hamstring the gun rights of the people as to render them practically useless.

Thus, there are hundreds of laws regarding firearms that directly infringe on the original intent, spirit, and purpose of the Second Amendment. These laws are illegal and are therefore null and void, as the Framers indicated on numerous occasions when they mused about the future possibility that laws would be passed by tyrannical representatives that ignored Constitutional prohibitions.

  2. Genie, it wouldn’t have mattered had it been engraved in gold on the street in front of the WH.
    When we were going to high school and college, usually, we only studied what we knew would be on the test. Right?
    That is the case of Obama. He was NEVER a great lawyer, he ONLY studied what issues written in the Constitution that would get in his way.

  3. The vitally important question is one of organization. HOW do millions of patriots willing to take up arms against those who have directed law enforcement to confiscate their weapons, how do they organize into militia groups of hundreds or thousands? Who will organize a force of 1 million to march on Washington in order to “change the minds” of lawmakers? How will it be done?
    Patriots will have an advantage of numbers. But how will that advantage be translated into victory? Simply running through the front door with an AK won’t get it done!

  4. While the web is still available, have town, city and county militias join into a coalition across the nation. If/when the web becomes unavailable, use land phones, snail mail, carrier pigeons, Morse code, face to face, etc. etc.

    Obama has conceded that our constitution is not congruent or favorable to the changes” he is effecting. It is tough for him to work around very clear statements and laws affording us the freedoms that he seeks to dispose of or disable. He is not smart enough to work that out, but rest assured, he has enough well paid attorneys and marxist liberals to manipulate the words and intent of our constitution to his own ends. It is very sad that many of us let this Kenyan fake and liar become so entrenched in our personal protections and security, he himself is becoming the new law. He has made it very clear that the Islams and muslims are his priority in spite of his old and useless rhetoric he spews out to assure his sheep he is a patriot of this country.
    We do not need or want Sharia law in this country. We do not need the muslims beheading those that disagree with their violent and sadistic religion in this country! Obama is allowing all this..for the venom of the muslim brotherhood and islamic terrorists to spread in this nation creating a country of oppression and total government overreach. He is a socialist muslim and a liar and those that are still worshiping this Kenyan bastard are taking this country down and helping Obama to destroy us..one day at a time.

  7. Doug, I have been blasted for saying the same thing you just said. It is so easy to sit in the comfort of your home and talk big, “lock ‘n load.”

    So? Do you “lock ‘n’ load” before or after work? Do you lock ‘n’ load after you pick the kids up from school or before?

    While you are gone with _____ to fight the fight…who pays your mortgage, car payments, etc.? Are you neighbors going with you? Your friends? How many? Where do you meet with what kind of force? Where do you go together to fight against ___who?

    While I can appreciate the thought…the reality is much more difficult.

    Many will use the “I must take care of the kids/pay the mortgage” excuse to do nothing when the Gestapo come up their driveway to confiscate their guns. These people will then be slaves, taking care of the kids they just offered up as future slaves. Aren’t they to be congratulated for taking such good care of their kids! Of course, it’s never difficult for a coward to find an excuse for being what he is. “The kids come first, so naturally I must relinquish my guns.”
    I would guess that 5% of Americans will actually fight when the times comes. Fifteen million will give no excuse and accept none from others. It will be a formidable force if means of organization and communication can be found. It’s just a shame that it will be necessary.

    Anyone know what happened to the group “Anonymous”? I am sure there are more groups forming that intend to defend their homes and rights against the intruder Obama. What can the average person do? How about stand resolute and strong and vow to not be intimidated when the time comes. Assess your skills, no matter how small you think they may be, and be ready to volunteer and give of yourself. Even if it is calling on the phone, opening your home for meals or rest. Sounds a bit weird I know, but it is better to be prepared and feel your participating in saving your home and country.
    There should be a database of volunteer homes across this nation.

  12. Some sort of database is a good idea, Regina. Once the left has begun gun confiscation, it may well be too late to start one.
    One other idea–already hundreds of sheriffs and police have vowed to NOT uphold laws demanding the corruption of the Constitution and the 2nd Amendment. Lists of the names of these “Oathkeepers” (a great website) have been provided on the web. Contact with these individuals by their “private citizen” friends could keep the rest of us up on the moves of the gun grabbers. Just a thought.
    Also, if police depts and sheriffs offices have lists of gun owners to be raided and guns to be confiscated, one of these officers might provide the patriots in their area with them. A great heads-up.

    Intimidation is a staple of the Obama Regime especially and of the left in general. A former soldier in New York was found with a couple of 30 round AR magazines in his car and now faces up to 7 years in prison thanks to the new, thoroughly corrupt and unconstitutional Cuomo law. The left in NY will undoubtedly make an example of him for the other gun owners in the state. (I believe Jim might have carried the story here on We the People.)
    I would buy a drink for the STATE if a few thousand patriots stormed the courthouse in which his hearing will be held and rescued him!!! That would be the greatest and most welcome news story of the past 3 decades!! In any event, that is the sort of aggressive, anti-gun grabber behavior which will be necessary if the left is to be stopped.
