Obamacare Awakens a Sleeping Giant: Constitutional Problems

Yes Nancy, you should have read the bill before you signed it because now that you and yours have begun to find what’s in it you have created a serious breach between Church and State.   As the progressives who passed laws with no concern with the Constitution, this time they have made a huge mistake. 

You have managed to unite virtually all Western Religions against your scheme let’s venture to say they completely out number your supporters, the Union Thugs

Ask Muslims with out the revisionist history what happens when they pushed the Catholic Church and Christianity too far! 

It is a rare moment indeed when faith denominations of all stripes unite together in common cause, and it is rarer still when that cause is a political one, with a sole piece of legislation as its principal target. But when that law eviscerates the very foundation of religious liberty in America as protected under the First Amendment, it should not be surprising that Catholics and Jews, charismatic evangelical Christians, and mainline Lutherans alike find common cause in defense of their liberties.

Such is the case with the firestorm of opposition to Obamacare and the Obama Administration’s attack on religious liberty.

 

Under a new Obamacare mandate issued by the U.S. Department of Health and Human Services (HHS), the White House is mandating that many religious employers, with the exception of churches, provide health care coverage for contraception — including abortion-inducing drugs — thereby trampling upon their constitutionally guaranteed free exercise of religion. And it is this mandate that has caused a vehement response in churches and synagogues across the country.

Yesterday, the head of the Catholic League, Bill Donohue, warned that the nation’s 70 million Catholics are ready to go to war with the Administration’s dictates, saying “Never before, unprecedented in American history, for the federal government to line up against the Roman Catholic Church. This is going to be fought out with lawsuits, with court decisions, and, dare I say it, maybe even in the streets.”

Donohue’s remarks follow those of the U.S. Conference of Catholic Bishops and at least 153 Catholic bishops across the country who have weighed in with opposition to the mandate. “We Catholics will be compelled to either violate our consciences, or to drop health coverage for our employees and suffer the penalties for doing so,” wrote Bishop Alexander Sample of Marquette, Michigan. Those penalties include fines imposed by the federal government that could cost larger organizations millions of dollars per year.

The Catholic Church is not alone in its opposition to Obamacare’s onslaught against religious freedom. David Addington, The Heritage Foundation’s vice president of Domestic and Economic Policy, details the growing ranks of the faithful who say the Obama Administration has crossed a very dangerous line. The National Association of Evangelicals commented that “The HHS rules trample on our most cherished freedoms and set a dangerous precedent” and the Union of Orthodox Jewish Congregations of America stated, “In declining to expand the religious exemption within the healthcare reform law, the Obama Administration has disappointingly failed to respect the needs of religious organizations such as hospitals, social welfare organizations and more.” The Agudath Israel of America stated its opposition, as did the Lutheran Church Missouri Synod and the Assembly of Canonical Orthodox Bishops of North and Central America.

The Obama Administration is beginning to feel the pressure. On Sunday, HHS Secretary Kathleen Sebelius authored an op-ed in USA Today defending the Obama Administration’s actions, claiming that a very narrow exemption to the mandate is evidence that the White House is “working to strike the right balance between respecting religious beliefs and increasing women’s access to critical preventive health services.” That exemption, though, does not apply to institutions like religious schools and hospitals. Sebelius might claim the Administration is offering grace to people of faith, but in fact it is not. In an editorial that ran the same day as Sebelius,’ USA Today agreed with those standing on the side of religious liberty, writing that “in drawing up the rules that will govern health care reform” the Obama Administration “galloped over” the line and violated the “simple proposition that the government should steer away from meddling in church affairs.”

The Obama Administration’s actions, though entirely counter to the freedom of religion, should not be surprising given the nature of the President’s health care law. Obamacare has given the federal government broad power over one-sixth of the American economy and thereby purports to grant Washington the power to force religious institutions to take actions contrary to their faith. Addington writes that this kind of concentration of power “has proved to be a drastic and dangerous experiment.” America’s religious leaders and the faithful have awoken to this wolf at their door and are lashing out in defense of their freedoms. Congress, too, should act now by repealing Obamacare and restoring the religious liberty that is so central to our way of life.

  1. THERE HE GOES AGAIN DICTATING, THE CHURCH MORE OR LESS TELL HIM WHERE TO GET OFF. HE OPENS HIS MOUTH WITHOUT CHECKING CONSTITUTION. IF A COMPANY WANTS TO DO THIS FINE AND DANDY BUT YOU DON’T TELL ANYONE THEY HAVE TO PROVIDE.

    Obama April 2008: “They get bitter, they cling to guns or religion or antipathy to people who aren’t like them or anti-immigrant sentiment or anti-trade sentiment as a way to explain their frustrations.”

    The way I see it: I don’t cling to my guns or religious beliefs because of bitterness. My right to keep and bear arms and my right to freedom of religion are both guaranteed by the Constitution of The United States of America and The Bill of Rights, period… end of discussion. Anyone who tries to unlawfully relieve me of these rights is guilty of treason and should be prepared to pay a very heavy price.

    Now, as for being anti-immigrant… As long as a person of foreign nationality is willing to come into this country legally and become an American citizen by through the process that is established for that purpose AND as long as they are willing to swear allegiance to our nation and abide by its laws then by all means… come on ahead. Welcome to America, land of the free and home of the brave. But if you intend to sneak in or enter the USA under false pretense not only are you unwelcome here, you should be hunted down and deported to whence you came.

    With respect to anti-trade… Trade is one of the cornerstones of any capitalist nation. As long as there are jobs enough for all Americans then the import and export of raw material and manufactured goods is a necessity. But America’s interests and the interests of the American people should always come first. Globalization for the sake of elevating third world nations at our own expense is pure, unadulterated socialism and flies in the face of everything this nation stands for.

    Back in 2008 even Hillary Clinton (I’m not a fan of hers, just giving the devil her due) called Obama out on his remarks…

    Hilary Clinton April 2008: “I was taken aback by the demeaning remarks Senator Obama made about people in small-town America,” “His remarks are elitist and out of touch.” Clinton campaigners in North Carolina handed out stickers saying: “I’m not bitter.”

    So Obummer, you wanna take a shot at relieving me of my 1st Amendment rights? Not sure what YOU are prepared to do or far YOU are willing to go in such an undertaking; but I know exactly what I am prepared to do to protect my Constitutional rights- WHATEVER IT TAKES!

  4. Here’s the thing, and you’re welcome to check this:
    If there’s no way to show the law was wriiten expressly to dsicriminate against religion on the abortion issue, i.e., that it was wriiten as a neutral mandate to provide all possible health care to employees, then it won’t be found unconsitiutional. Laws that incidentally impact the free practice of religion w/o a specific intent to infringe are not usually found unconstiutional.
    Sorry.

    BTW – Stop blaming Obama for problems the Bush boys created lol. You must see a big part of this is carry over. Wow,

    • Joseph, I don’t need to check anything out. If a church does not want or allow contraception, the government cannot impose its will upon religion(s) I suggest you pick up a copy of the Constitution. Not usually found unconstitutional? Do you ever bother to source your foolish allegations? The opposite is true and the Supreme court sides with the church more often than not. As to your assertion that I quit blaming Obama for what “the Bush boy created” I suggest you pick up a book that explains the failure of Obama’s administration. Sorry, you are always welcome here but if this is the sum total of your intellectual fire power, you will just be considered in flight entertainment and laughed at by my reader. So I challenge you, come back with well sourced documentation, and you will be treated with respect as I have just done so here. The History of Church and State and Supreme Court Decisions.

    The Liberal Supreme Court started the separation of church and state that is not in the constitution to help get Religion out of the public. The Forefathers wanted Religious Freedom everywhere including the public square. That is the way it should be. Now this Communist President wants to tell Catholic Hospitals and Clinics to dispense contraceptives, the pills that you are supposed to take to stop a pregnancy, all things the Church does not believe in doing. They will Fight this and I am Glad. We have freedom of Religion. That means the Government should not make any laws regarding Religion. With all the Religions mad, I think Obama will have to back off or face many, many, many, many lawsuits.

  7. I read somewhere that Muslims will probably be exempt from Obamacare because Sharia law says insurance is a form of gambling. If unions etc. are going to be exempt, than why are church run schools and hospitals forced to comply with the mandate?

  8. Muslims are exempt that is true. But ask yourself why is Obama doing after telling the Catholic church a few years ago that he would not include them in the birth control area. Why to incite violence – or at least a protest that then will turn to violence once he sends in occupy to stir up things and turn violent. Thus envoking martial law, which equals taking guns. So I hope the churches stay calm and just wait for new leadership and wait for the repeal.

  10. I just finished a conversation about this same issue. My list may be short, so please feel free to add to all the Big Corporations he has already stomped on (or threatened to do so) and now the church? It doesn’t matter to any of us who AREN’T Catholic because he has now set a precedent that no one is safe:
    In going after the Internet with threats of Govt. Control he ticked off wealthy corporations such as:
    Verizon (who saved us once already); Time Warner, AT&T, SW Bell, Comcast and others.
    He has also gone after freedom of speech against Christians vs. Muslims;
    He has gone after the Military in cutting retirement pay; and more or less stood up for those who murdered Military Personnel (Ft. Hood) commenting that he (or anyone) were supposed to have their Miranda Rights read — as all of us know, when it is a matter of Public Safety, it is NOT necessary to recite Miranda
    My own doctor went out of business due to ObamaCare; My brother-in-law moved to Brazil because Obamacare ruined him also. I am not the only one who has had problems finding a new doctor.

    He threatened in the beginning to put anyone in jail if they didn’t have insurance. THIS MAN knows no boundaries when it comes to the Citizens and and the U.S.

    As I requested before: Please add anyone I may have left out.
    This man is making a huge, important list of enemies.
